1. About These Terms

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“you”, “your”, “User”) and RESCUQR Technologies Private Limited (“RESCUQR”, “we”, “us”, “our”), a company incorporated under the Companies Act, 2013, with its registered office in Hyderabad, Telangana, India.

By accessing our websites at rescuqr.in and rescuqr.com (the “Site”), purchasing a RESCUQR product, creating or using an emergency profile, scanning a RESCUQR code, calling our support line, or otherwise engaging with our services (collectively, the “Services”), you agree to be bound by these Terms together with our Privacy Policy and our Refund, Returns & Cancellation Policy. If you do not agree, please do not use the Services.

These Terms are governed by, and shall be read together with, the Information Technology Act, 2000 and the rules made thereunder, the Digital Personal Data Protection Act, 2023, the Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020, the Indian Contract Act, 1872, the Sale of Goods Act, 1930, and other applicable Indian law.

2. What RESCUQR Is — and What It Is Not

(a) RESCUQR is an emergency identity and response-coordination platform. We provide: (i) physical products that carry a QR code linked to your emergency profile — the Emergency Wristband, Emergency Keychain and Emergency Sticker; (ii) a scan flow, in which a bystander who scans your QR verifies themselves (name, phone number and a one-time password) and is then shown the emergency information you have approved, with one-tap calling and a family-alert / location-sharing action; (iii) a 24×7 call line for conscious users; and (iv) a RESCUQR Quick Response Team that, on a best-efforts basis, contacts your emergency contacts and coordinates the nearest hospital and/or an ambulance through independent third-party providers.

(b) What RESCUQR is NOT. RESCUQR is not a hospital, clinic, doctor, ambulance operator, pharmacy, diagnostic centre, clinical establishment, medical-device manufacturer or telemedicine provider. We do not provide medical treatment, diagnosis, first-aid or clinical advice, and using the Services does not create any doctor–patient relationship. Our products are identity carriers, not medical devices, and perform no diagnostic or therapeutic function.

RESCUQR is not a substitute for emergency services

In any emergency you (or a bystander) should first call the national emergency number 112 (or 108 for ambulances). RESCUQR is an additional layer of help and coordination and must not be relied upon as the sole or primary means of obtaining emergency medical care. We do not guarantee that help, an ambulance, a hospital or our Quick Response Team will be available, will respond, will respond within any particular time, or will produce any particular outcome.

3. Eligibility & Capacity

(a) To purchase a product, create a profile or agree to these Terms, you must be at least 18 years of age and have the legal capacity to enter into a binding contract under the Indian Contract Act, 1872.

(b) If you enrol an emergency profile for a minor or a person with a disability, you represent that you are the parent or lawful guardian and consent on their behalf in accordance with Section 9 of the DPDP Act, 2023.

(c) If you engage with us on behalf of a society / RWA, builder, corporate, school, college or other entity, you represent and warrant that you are duly authorised to bind that entity.

4. Your Account & Emergency Profile — Accuracy Is Your Responsibility

(a) You are responsible for the accuracy, completeness and currency of every detail in your emergency profile (including blood group, allergies, conditions, medications, treating doctor, preferred hospital and emergency contacts). RESCUQR does not verify medical information and is not liable for harm arising from information that is inaccurate, incomplete, outdated or mis-entered by you.

(b) You must keep your login credentials secure and promptly update your profile when your details change.

(c) You control which fields are displayed on a scan, other than actions essential to the safety function (such as emergency-contact calling).

5. Emergency Contacts & Third-Party Information

If you add another person’s details (for example, an emergency contact), you confirm that you have that person’s consent to share their name and number with bystanders and our Quick Response Team for emergency purposes, and you indemnify RESCUQR against any claim by that person arising from your having added them.

6. The Scan Flow — Terms for Bystanders / Scanners

Any person who scans a RESCUQR code and accesses a profile (a “Scanner”) agrees that: (a) access is granted only to help the user in a genuine emergency; (b) they will provide truthful verification details, which are logged; (c) they will not record, copy, retain, publish, sell or otherwise misuse any information seen; and (d) misuse may constitute an offence under the DPDP Act, 2023, the Information Technology Act, 2000 and the Bharatiya Nyaya Sanhita, 2023, and may attract civil and criminal liability. A Scanner acting in good faith to help an injured person is a “Good Samaritan” and is protected under Section 134A of the Motor Vehicles Act, 1988 and the Good Samaritan Guidelines, 2016.

7. Products, Orders, Pricing & Delivery

(a) Product prices, availability and any discounts are shown at the point of purchase and are subject to change until your order is confirmed.

(b) Products are personalised — each QR is uniquely engraved / printed and linked to your profile — and are therefore made to order.

(c) Ordering, delivery, warranty, returns and refunds are governed by these Terms and our Refund, Returns & Cancellation Policy.

(d) Implied conditions and warranties under the Sale of Goods Act, 1930, and rights under the Consumer Protection Act, 2019, that cannot be excluded by law are not excluded.

8. Programmes: Rescuers & Community / RWA Cover

(a) The Rescuers programme is a free community initiative; joining creates no employment or agency relationship and no obligation on RESCUQR to engage any person.

(b) Where RESCUQR provides an emergency-cover arrangement to a society / RWA, builder, corporate or institution, the commercial and operational terms are recorded in a separately signed agreement, which prevails over these Terms for that engagement to the extent of any conflict.

9. Acceptable Use

You agree that you will not: (a) submit false, unlawful or infringing content; (b) misuse, probe, scrape, overload or attempt to breach the Site or its security; (c) use the Services other than for their intended, lawful emergency-support purpose; or (d) infringe any third-party right. We may suspend or terminate access for breach.

10. Intellectual Property

The RESCUQR name, logo, Site, software, designs and content are owned by or licensed to RESCUQR and are protected under the Copyright Act, 1957 and the Trade Marks Act, 1999. You receive a limited, revocable, non-transferable licence to use the Services. You grant RESCUQR a licence to use the data you submit solely to operate and improve the Services as described in our Privacy Policy.

11. Disclaimers

The Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, RESCUQR disclaims all warranties not expressly stated, and does not warrant that the Services (including scanning, connectivity, OTP delivery, calling, location, the Quick Response Team or any third-party response) will be uninterrupted, timely, error-free, or effective in any particular situation. Availability depends on mobile networks, power, third parties and factors beyond our control.

12. Limitation of Liability

(a) To the maximum extent permitted by law, RESCUQR (and its directors, employees and partners) shall not be liable for any indirect, incidental, special, punitive or consequential loss, or for any loss arising from (i) inaccurate or incomplete user data, (ii) the unavailability, delay or failure of networks, third-party hospitals, ambulances, telecom or payment providers, or statutory emergency services, or (iii) any bystander’s acts or omissions.

(b) Subject to (c), RESCUQR’s total aggregate liability arising out of or in connection with the Services shall not exceed the amount you paid to RESCUQR in the twelve (12) months preceding the event giving rise to the claim, or ₹5,000, whichever is higher.

(c) Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable Indian law, including your rights under the Consumer Protection Act, 2019 and liability for death or personal injury caused by our proven gross negligence or wilful misconduct.

13. Indemnity

You agree to indemnify and hold harmless RESCUQR against any claims, losses and reasonable costs arising from your breach of these Terms, your inaccurate or unlawful data, your addition of third-party details without consent, or your misuse of the Services.

14. Force Majeure

RESCUQR shall not be liable for any failure or delay caused by events beyond its reasonable control, including network or power failure, acts of God, natural disaster, epidemic or pandemic, government action, civil unrest, war or third-party outages.

We acknowledge complaints within 48 hours and endeavour to resolve them within 30 days.

16. Governing Law, Dispute Resolution & Jurisdiction

These Terms are governed by the laws of India. The parties will first attempt to resolve any dispute amicably; failing which, the dispute shall be referred to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996, seated at Hyderabad, conducted in English. Subject to arbitration and to any non-excludable consumer-forum jurisdiction under the Consumer Protection Act, 2019, the competent courts at Hyderabad, Telangana shall have exclusive jurisdiction.

17. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified on the Site and, where we have your email address, by email, and take effect as stated in the notice. Continued use of the Services after changes take effect constitutes acceptance.
