1. About These Terms
These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“you”, “your”, “User”) and RESCUQR Technologies LLP (“RESCUQR”, “we”, “us”, “our”), a private limited company incorporated under the Companies Act, 2013, with its registered office in Hyderabad, Telangana, India.
By accessing or using the RESCUQR website at rescuqr.in (the “Site”), filling in any of our onboarding or waitlist forms, or engaging with any of our services described below (collectively, the “Services”), you agree to be bound by these Terms together with our Privacy Policy and our Refund & Cancellation Policy. If you do not agree, please do not use the Site or the Services.
These Terms are governed by, and shall be read together with, the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023, the Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020, the Indian Contract Act, 1872, and other applicable Indian law.
2. What RESCUQR Does
RESCUQR is building a connected emergency-care network for India. We do not directly provide medical treatment. We design, coordinate and operate a network that brings together licensed ambulance operators, hospitals, paramedics, pharmacies, diagnostic providers and other partners, with software and processes that aim to make emergency care faster and the medical journey smoother.
Our current Services include:
(a) Community Emergency Medical Cover (Phase 1). A stationed 24×7 ambulance service offered to gated communities, RWAs, builders, corporates, schools, colleges and similar organisations, in either “Cluster” (shared) or “Dedicated” (exclusive) deployment models. Add-ons may include a dedicated paramedic, elder home-care visits, an on-site medical room, an RWA dashboard, and a 24×7 control line.
(b) Rescuers Programme. A community of doctors, paramedics, drivers, organisers, students, volunteers and other supporters who join a waitlist and may be invited to participate in pilots, drills, awareness programmes and other community-building activities.
(c) Optional Medical-ID Wristband. A medical-grade silicone wristband with a laser-engraved QR code that, when scanned, displays the wearer’s emergency medical profile and emergency contacts (subject to the wearer’s privacy settings). Where the wristband is offered as a separately purchasable product, it carries its own ordering, delivery and refund terms made available at the point of purchase.
(d) Future Services. Over time we intend to add further layers — hospital integrations, AI prescription checks, pharmacy delivery, diagnostic referrals and insurance trust services. Each will be governed by these Terms together with any additional service-specific terms made available at that time.
The specific scope of Services delivered to any partner community is recorded in a separately signed agreement with that community.
3. Eligibility & Capacity
(a) To submit any form, agree to these Terms or transact with us, you must be at least 18 years of age and have the legal capacity to enter into a binding contract under the Indian Contract Act, 1872.
(b) If you are engaging with us on behalf of a builder, RWA, society, corporate, school, college or other entity, you represent and warrant that you are duly authorised to do so and to bind that entity.
(c) If you enrol an emergency profile or wristband for a minor or a person with disability, you represent that you are the parent or lawful guardian and consent on their behalf in accordance with Section 9 of the DPDP Act.
4. Use of the Site & Forms
(a) You agree to use the Site and our forms only for lawful purposes and only in a manner that does not infringe the rights of, or restrict or inhibit the use of the Site by, any third party.
(b) You agree to provide accurate, current and complete information when you fill in any form. You will promptly update us if any material information changes.
(c) Submitting a form does not, by itself, create an obligation on RESCUQR to provide any Service. Service provision is subject to acceptance, signed agreement (where applicable) and any onboarding conditions.
5. Partner Engagements (B2B)
(a) Where a builder, RWA, society, corporate, school, college or similar organisation engages RESCUQR for Community Emergency Medical Cover, the commercial and operational terms — including scope, pricing, billing schedule, deployment model, SLAs, escalations and exit — are set out in a separately signed agreement between RESCUQR and that organisation.
(b) In the event of any conflict between these Terms and that signed agreement, the signed agreement prevails in respect of the specific Services covered by it.
(c) Onboarding form submissions are enquiries only and are not binding offers.
6. Rescuers Waitlist
(a) Joining the Rescuers waitlist is voluntary, free of charge, and does not create an employment, contractor, partnership, agency or joint-venture relationship with RESCUQR.
(b) Waitlist sign-up does not guarantee participation in any pilot, paid programme or other activity. RESCUQR may, at its discretion, invite specific waitlist members to participate in specific programmes based on fit.
(c) Where a Rescuer is invited to participate in a programme that involves payment, contractual obligations, access to sensitive areas or interaction with patients, separate written terms will be put in place for that programme.
7. Optional Medical Wristband & Emergency Profile
(a) Use of the wristband is optional. Where you choose to purchase a wristband and create an emergency profile, the information you enter is processed under our Privacy Policy and displayed on the public scan page based on the privacy toggles you choose.
(b) You are solely responsible for the accuracy and completeness of the medical information you enter. Inaccurate or out-of-date information may lead to adverse outcomes during an emergency. RESCUQR has no obligation, and does not undertake, to verify the medical information you provide.
(c) You must promptly update the profile if your medical information changes.
8. Important Disclaimers
(a) RESCUQR is not a hospital, a medical practitioner, an ambulance service licensee or an emergency services agency. Where we coordinate care, the actual medical service is delivered by licensed third-party partners (ambulance operators, paramedics, hospitals, pharmacies, diagnostic providers).
(b) RESCUQR does not provide medical advice, diagnosis or treatment. Any information shown on the Site or in any communication is for general informational purposes only and is not a substitute for professional medical advice.
(c) In any life-threatening emergency, always call 112 (National Emergency Number) or your local emergency services first, in parallel with any contact with RESCUQR.
(d) Availability of Services, response times and routes depend on factors outside our reasonable control, including traffic, weather, force majeure events, network coverage, partner availability and equipment availability.
(e) The Site and Services are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, save to the extent such warranties cannot be excluded under applicable law.
9. Limitation of Liability
(a) To the maximum extent permitted by applicable law, RESCUQR, its directors, officers, employees, agents and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or business opportunities, arising out of or in connection with the Site, the Services, or these Terms.
(b) Without prejudice to (a), the aggregate liability of RESCUQR under or in connection with these Terms in any twelve-month period shall not exceed the amounts actually paid by or on behalf of you to RESCUQR during that period or, where no amount has been paid, INR 5,000 (Indian Rupees Five Thousand).
(c) Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law (for example, liability arising from fraud or wilful misconduct).
10. Data Protection
(a) RESCUQR acts as a Data Fiduciary under the DPDP Act, 2023 in respect of personal data processed through the Site and Services.
